1) About these terms
These Terms & Conditions apply to your use of the Arcwell website at arcwell.consulting (the Site). By using the Site, you agree to these terms. If you do not agree, do not use the Site.
The Site is directed to business users in the United Kingdom. Engagements for paid services are governed by a separate Master Services Agreement / Statement of Work between Nevrast Consulting Ltd and the relevant client. If there is any conflict, the contract with the client prevails for the services covered by it.

2) Other terms that may apply
Our Privacy Policy, Cookie Notice, and (where relevant to clients) our Data Processing Addendum (DPA) also apply to your use of the Site. They explain how we handle personal data and cookies and form part of these terms by reference.

3) Changes to the Site and to these terms
We may update and change the Site from time to time to reflect changes to our services, users’ needs and our business priorities. We may also amend these terms. The latest version is posted on this page with the effective date above.

4) Availability of the Site
We do not guarantee that the Site, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw, or restrict the availability of all or any part of the Site for business and operational reasons.

Content on the Site is provided for general information only. It is not advice. While we try to keep content accurate and up to date, we make no representations, warranties or guarantees, whether express or implied, that the content is accurate, complete or up to date. Any performance figures or case-like examples are illustrative and not a promise of future results.

The names Arcwell and Nevrast Consulting Ltd, and our logos, are unregistered trade marks; you must not use them without permission.

You may link to our homepage in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement where none exists, and you must not frame our Site on any other site. We reserve the right to withdraw linking permission without notice.
Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources.

9) Uploads, feedback and prohibited data
Do not submit confidential or commercially sensitive information via public forms on the Site. If you choose to provide feedback or suggestions, you grant us a non‑exclusive, royalty‑free licence to use that feedback to improve our services. Please do not include special category data or others’ personal data unless we have requested it and a suitable legal basis is in place.

We do not guarantee that the Site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access the Site. You should use your own virus protection software.

11) Our responsibility for loss or damage suffered by you
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

These terms, their subject matter and their formation are governed by the laws of England and Wales. You and we agree that the courts of England and Wales will have exclusive jurisdiction.
